摘 要

中小企业在我国市场经济中占有非常重要的位置，市场活力极强，是技术创新的主力军，其中67％以上的专利、76％以上的技术创新、85％以上的新产品开发，都是由中小企业完成的。但我国知识产权局官方公布的有关专利申请和有效专利的数据暴露了我国专利转化存在的问题---转化率低下，即每年有非常多有潜力的专利被无限期搁置，造成专利资源的大量浪费。我国中小企业是国民经济的根基，所以要重点研究中小企业的专利转化问题。本文以我国中小企业为研究对象，针对其专利转化率低、专利质量不高等问题，以基础理论和模式为出发点，从法律制度、政策、模式机制、市场、中介服务机构等方面进一步分析中小企业专利转化存在的困境及原因，进行有针对性、全面性研究，提出完善专利转化体系的建议，培养中小企业的创新意识，促进发明改革，加快我国经济的增长。

Abstract

As the foundation of our country's economy, small and medium-sized enterprises is the basis of the national economy.They send out in the market economy flourishingly vitality, the main force of technological innovation, with more than 67% of the patents, more than 76% of the country's technology innovation, more than 85% of new product development, are done by the small and medium-sized enterprises. But the official data of China's intellectual property office on the effective patent application and patent exposed the problem of patent transformation in our country - conversion rate is low, namely, every year there are so many potential patents can be put on hold indefinitely, causing huge waste of patent resources. Due to a significant role in the enterprise of our country small and medium-sized enterprises, small and medium-sized enterprise patent transformation problem research is imperative. As the research object, this article takes our country small and medium-sized enterprises for its patent conversion rate is low, quality is not high, with the basic theory and model as a starting point, from the legal system and policy model, mechanism of market further analysis of small and medium-sized enterprise patent into existence predicament and its cause of, targeted, comprehensive research, puts forward some countermeasures to improve the system of optimization of small and medium-sized enterprise patent transformation of, promote technology innovation of small and medium-sized enterprises, enhance their competitiveness, promote the economic growth of China.

第1章 绪论

1.1 研究背景

近些年来，我国中小企业飞速发展，数量已占我国企业的90％以上，在我国国民经济中处于重要地位，其自身科技含量高、产品独特新颖、实用性强，蕴含巨大的市场能量，成为发展市场经济的重要支撑。中小企业加快专利技术转化，提高专利转化的效率，对于推动国家或地区的经济增长，提高市场竞争力，增强综合实力具有非常重要的影响。

改革开放以来，专利权的保护强度逐渐加大，专利研究、申请与转化得到了前所未有的制度保障，企业创新意识增强，改善传统的技术和结构，推陈出新，促进了经济增长。但随着经济形势的不断发展变化，世界经济格局趋于一体，中小企业经营的国内外环境、资源环境、市场环境等都发生了变化，对专利提出了更高的要求，面临专利质量低、转化率差等一系列问题。2008年以来，国际金融危机的爆发，国际市场萎靡不振，国内市场波动较大，一些中小企业面临裁员、减薪，减产甚至倒闭，给经济和社会带来了很大的压力。所以在严峻的国内外经济形势下，中小企业必须克服市场波动大、成本增加等问题，提高专利技术转化率，加快转变发展方式、优化产业机构，才能在世界经济一体化格局中有一席之地。
