摘 要

改革开放以后，随着我国的经济快速发展，违章建筑的出现是城市化建设快速发展过程中普遍存在现象。在城市化推进的过程中，居民的收入增长率与房价增长率并不成正比，投入一定的价钱并不能获得令人满意的住房面积。城市居民为了尽可能扩大建筑物面积，搭建违章建筑便是最常见的低成本方法来增加建筑的使用面积。违章建筑虽然表面上看是满足了居民一时的私欲，但其中存在的各种隐患是难以估量的。除了居民为自身利益考虑选择搭建违章建筑之外，行政主管部门在治理城市违章建筑过程中也存在问题，如暴力行政、职能不明晰、效率低下、惩罚力度不到位等，城市违章建筑治理效果甚微，也正是因为治理不到位才酿成了很多惨案。因此，行政主管部门在治理过程中应不断反思，发掘存在的问题并针对性地加以改造，提升违章建筑治理的效率。除此之外，在多元化发展的当下，已经不再是政府个体垄断所有的管理活动，基层组织、社会组织、居民等主体都应当积极投入到城市违章建筑的管理活动中，对城市违章建筑进行有效的防治。

Govern on urban illegal building management

Abstract

After the reform and opening up, with the rapid development of China's economy, illegal construction is a common phenomenon in the rapid development of urbanization. In the process of urbanization, the growth rate of residents' income is not directly proportional to the growth rate of housing prices, so a certain price input cannot obtain satisfactory housing area. In order to expand the building area as much as possible, building illegal buildings is the most common low-cost way to increase the usable area of buildings. Although the illegal building on the surface is to satisfy the residents of the moment's private desire, but there are various hidden trouble is inestimable. In addition to the residents choose set up illegal buildings for its own sake, the competent administrative department for problems also exist in the process of city governance illegal structures, such as administrative violence, unclear functions, such as low efficiency, insufficient penalties, urban governance illegal buildings little effect, also it is because the management does not reach the designated position just caused a lot of tragedy. Therefore, the administrative department in charge of the governance process should continue to reflect, explore the existing problems and targeted to reform, improve the efficiency of illegal building management. In addition, in the current diversified development, it is no longer the government that monopolizes all the management activities. Grass-roots organizations, social organizations, residents and other subjects should actively participate in the management activities of illegal buildings in the city and effectively prevent and cure illegal buildings in the city.

绪 论

随着城市化进程的推进，虽然现阶段我国城市治理在理论和实践等各方面已经取得了一些成就，但同时城市违章建筑这一问题并没有能随着城市化得到解决。房价持续高涨导致居民为了满足一己私欲选择搭建违章建筑，与此同时相关部门的监管不到位、只重视政绩忽视治理等问题日渐突出。城市违章建筑成因复杂，如果该问题没能得到及时治理，将会影响整个城市可持续性的全方位发展，因此这对政府与多方主体的协同治理提出了更高的要求。

从理论层面上看，我国的城市违章建筑屡禁不止，但是与违章建筑治理相关的文献却比涉及其他领域的文献少得多，并且其中大部分都是从建筑学等方面对违章建筑本身进行分析和探索。鉴于此种情况，基于已有的理论研究成果，本文选择城市违章建筑的治理问题进行研究无疑是对现有理论的一个补充。
