摘 要
小区业主享有法律赋予其的自治权,有权根据其意志来管理小区的公共事务,同时行政机关也可以行使行政权来介入小区的公共事务。因此,在小区的公共事务中,处理好业主自治权与行政权的关系就显得十分重要。但是,在实践中经常存在行政机关在有些方面干预过多,但是在另外一些方面干预不足的问题。其中行政干预过度主要体现在行政机关过多扮演管理者的角色以及自治组织行政化现象严重。而行政干预不足主要体现在行政机关指导、服务不足以及行政机关监督不足。要想解决上述问题,首先要破除业主自治与行政权干预相互对立的观念,应该引导二者相互配合,共同维护业主的合法权益。我们一方面要加强业主自治权,鼓励和支持业主委员会的发展,推动自治组织去行政化,理顺业主委员会和居委会之间的关系。另一方面要转变行政机关在小区治理中的角色,行政机关放弃在小区治理中的主导,加强在小区治理中的指导和服务工作以及对自治组织的监督。

A study on the interference of the owner’s autonomy and administrative power in urban residential quarters
Abstract
The owner of the community enjoys the autonomy granted by law, and has the right to manage the public affairs of the community according to his will. At the same time, the administrative organ can exercise the administrative power to intervene in the public affairs of the community. Therefore, it is very important to handle the relationship between the owner's autonomy and administrative power in the community's public affairs. However, in practice, there are often problems in which administrative agencies intervene too much in some areas but insufficiently intervene in others. Among them, excessive administrative intervention is mainly reflected in the excessive role played by the administrative organs in the role of managers and the serious administrative phenomenon of autonomous organizations. The lack of administrative intervention is mainly reflected in the lack of guidance, services and supervision of administrative agencies. To solve the above-mentioned problems, On the one hand, it is necessary to strengthen the autonomy of the owners, encourage and support the development of the owners ’committee, promote the de-administration of autonomous organizations, and straighten out the relationship between the owners’ committee and the residents ’committee. On the other hand, it is necessary to change the role of administrative organs in community governance. Administrative agencies give up their leadership in community governance, strengthen guidance and service work in community governance, and supervise autonomous organizations.

一、问题的提出
根据我国《物业管理条例》的规定,我们所说的业主就是房屋的所有权人。然而在我国的现行法律体系中,对于业主自治权没有一个明确的规定。但是,在《物权法》和《物业管理条例》中都规定了小区业主在小区治理中所享有的权利以及所应该承担的责任,比如业主召开业主大会以及成立业主委员会的权利、直接或者间接管理小区公共事务的权利、承担小区公共部分管理维修的费用的义务等。同时《关于审理建筑物区分所有权解释》的司法解释明确指出,业主根据相关的法律法规以及相关决定享有相关的权利,承担相应的义务。因此,我们可以认为虽然现行的法律没有明确规定小区业主自治权的内涵,但是间接规定了小区业主自治权的具体内容,我们不能因为法律没有直接规定而否定业主自治权的存在。
