摘 要

著作权作为一种私权,在知识产权范畴内担任重要角色。在原则上，应当由权利人自己行使自己的著作权。然而在实际操作中，伴随着科技的迅速进步以及社会的迅猛发展，这也对保护传统的著作权形成了挑战。著作权的集体管理制度由此产生。著作权的集体管理组织管理权利人的相关权益是由其委托来实现的。它是传统个人著作权保护的补充，该制度是重要构成因素，存在现代著作权保护领域。组织在尊重著作权的前提下，核心是保护和实现其会员的著作权的权益，使用作品的效率是其追求，与此同时，传播的作品有效也得到发展，无论对于著作权人、使用者还是公众而言，都是有益的。当然，我国的文化事业的发展也在一定程度上得到了发展。

相比发达西方国家，国内著作权的集体管理出现比较晚，发展进程也迟缓，在法律制定上也有缺憾，未充分发挥其在管理制度上组织应该发挥的影响，在理论研究上也未全面深入。由于当今世界经济政治发展，越发密切的国际交往，对于知识产权的保护也越发凸显重要，所以，加强国内著作权集体制度的完善研究，对于著作权保护领域的发展体现了重要的现实意义和理论意义。

本文以《北京晚报》与中国音乐著作权协会之间的论辩当成切入点，从中梳理总结现阶段国内著作权的集体管理制度的现状，进而分析出该制度在立法上和实践上所面临的挑战，就这些问题的具体内容举出相应的完善意见。

Abstract

Copyright is an important part of intellectual property is a private right, in principle, should have their own copyright rights holders exercise.
