摘 要

地方立法权的合理配置对于充分利用立法资源、保障区域协调发展起到重要作用，省级行政区域在地方立法权的配置中扮演着重要角色。然而，江苏省地方立法权的配置模式存在着地域和领域上的不合理，致使出现诸多发展窘境。本文在深度解读十八届三中全会的决议、深刻分析江苏省实际情况的基础上，以江苏省地方立法权的合理配置问题为研究对象，在理论上对配置地方立法权提出配置理念、配置格局合理性的要求，在实践上提出了以下对策建议：形成“以点带线、以线带面”的较大的市的分布格局；建立“层层分配”的地方立法权分享制；统筹兼顾各领域的立法需求；完善地方立法权配置的配套措施。

Reasonable Allocation of Local Legislative Power

——Take Jiangsu Province as An Example

Abstract

Reasonable allocation of local legislative power plays an important role in making full use of legislative resources, ensuring the coordinated development of the district. However, the allocation model of local legislative power of Jiangsu Province faces much unreasonableness in respect of the region and the realm, resulting in the development dilemma. Based on a deep interpretation to the Decision passed on the Third Plenary Session of the 18th CPC Central Committee and a deep analysis on the actual situation of Jiangsu Province, this thesis regards the local legislative power of Jiangsu Province as the object of study, raises a claim in theory that the reasonable allocation of local legislative power should pay attention to the reasonability of allocating concepts, pattern and measures. Meanwhile, in practice, this thesis puts forward some proposals: forming a territorial distribution pattern of local legislative power, where a “a city dives one line,a line drives one area” distribution pattern of larger cities, with the combination a “reasonably distribute for every layer” local legislative power sharing system will be established; establishing a domanial distribution pattern of local legislative power where legislative requirements of every realm can be balanced; improve the relative coordinated measures to support the distribution of the local legislative power.
