摘 要

随着我国改革开放的全面深化，经济全球化的日益深入，我国发展市场经济越来越紧迫，我国政府为了顺应时代发展的要求强调发挥市场经济在经济中的决定性地位。党的十八届三中全会和四中全会的相关决议之中，明确提出要大力依法加快国有企业混合所有制改革进程，我国的国有企业的混合所有制改革显得尤为紧迫。我国实行以国有经济为主导，多种所有制企业并存的经济制度。其中，混合所有制中的国有资本即国有产权不断受到侵犯，这一现象尤其需要受到重视，加强对混合所有制企业中国有产权的保护是我国国有企业混合所有制改革的关键。本文在分析混合所有制、国有产权的基本理论的基础上，着重阐述了我国混合所有制企业中国有产权保护存在的问题，针对我国混合所有制企业中国有产权保护存在的问题提出了相应的解决对策，以便更好完善我国混合所有制企业中国有产权的保护，推荐国有企业的改革。

Abstract

Along with the deepening of reform and opening-up policy and economic globalization, the development of market economy is more and more pressing. Our government require to give play to the conclusive status of market economy for comply with the development of age. The decision of the 18th the Third Plenum and the fourth plenary session had clearly put forward that our reform of mixed ownership in state-owned business seems very urgent, so we need to accelerate the progress of the reform. Our economic system takes state-owned business as the principal thing and is coexist with multiple ownership company. In this system, this phenomenon needs to be paid attention to that state property right is being violated. Enhancing the protection of state property right in the mixed ownership company is the key of the reform of mixed ownership in state-owned business. This article seriously sets forth problems about protection of state property right in mixed ownership company on the base of analyzing basic theory of mixed ownership and state property right. This article also puts forward some advice to solve the existed problem in the protection of state property right, in order to perfect the protection of state property right in mixed ownership company and advance the reform of state-owned business.

1.1 研究目的及意义

随着市场经济的发展和对外开放水平的日益深入,我国混合所有制企业在数量和规模上获得了较快发展。特别是国有企业改革的进一步深化,国有资本从竞争性的行业、产业逐步退出,促进了混合所有制企业快速发展。混合所有制经济越来越成为国有资本、集体资本、非公有资本等产权主体相互融合、共同发展的推动力量。但长期以来国家对国有资本、集体资本产权的保护和对非公有资本产权的保护不平等、不均衡,一方面存在私营、个体、外资等非公有资本的产权没有得到平等保护的问题,另一方面也存在国有资本、集体资本的产权保护机制僵化、缺位等问题,这就需要一系列的政策和措施来对国有产权进行保护。

改革开放前，我国实行的是单一的计划经济体制，企业从所有制结构上来分，只有全民所有制企业和集体所有制企业。随着改革开放，单一的公有制结构开始被打破，随之出现了私人入股、联合投资等众多的经济联合企业。改革开放几十年来，我国混合所有制出现了国有、集体、私营、外资、个人及其他社会法人产权主体共同投资入股、相互融合的局面。近几年，混合所有制企业数量和规模迅速发展。在看到混合所有制企业飞速发展的同时，我们也当认识到这其中存在的问题。完善混合所有制企业国有产权的保护制度，这关系到混合所有制经济的健康发展，对我国现代企业制度的建立以及经济社会的可持续发展具有重要的理论和实践意义。
