摘 要

本文首先通过解释环境卫生和环境卫生执法以及环境卫生执法主体和相对人等多个概念，来理清环境卫生执法中的执法内容和双方之间的法律关系，从而方便对环境卫生执法中存在的困境进行深入剖析。通过对环境卫生执法中的困境进行剖析和解释，以及对武汉市在环境卫生执法中的三个案例进行样例分析，从而得出与上述困境相对应的对策。

论文主要研究了环境卫生执法中存在的困境和对策。环境卫生执法中的困境包括执法主体和相对人两个层面的困境。执法主体层面包括立法依据不足、执法程序不规范、执法队伍法律素养不高三部分。执法相对人层面包括法律素养普遍不高、思想观念落后。环境卫生执法的对策也是针对执法主体和相对人双方展开的，包括加强执法队伍法律素养、分清各部门职责、通过绩效考核提高执法效率、通过群众听证会监督执法方式、执法相对人层面的完善、加强环境卫生法律宣传、建立群众环卫互相监督机制、营造环卫事业高尚社会氛围、执法中的主体之间的互动和监督。

Abstract

Firstly, through interpretation of multiple concepts of sanitation and environmental health law enforcement and environmental health law enforcement main body and relative people, to clarify the legal relationship between enforcement of environmental health in the enforcement of both the content and, thus convenient to the plight of the enforcement of environmental health in the presence of in-depth analysis. Through the analysis and interpretation of the plight of environmental health law enforcement, as well as the case of Wuhan city in the three cases of environmental health law enforcement analysis, so as to obtain the corresponding countermeasures.

This paper mainly studies the problems and Countermeasures of environmental sanitation law enforcement. The dilemma of law enforcement in environmental sanitation includes two aspects, the main body of law enforcement and the dilemma of the relative people. The main level of law enforcement, including the lack of legislative basis, law enforcement procedures are not standardized, the law enforcement team legal literacy is not high. Law enforcement relative to the human level, including legal literacy is generally not high, the idea behind. The Countermeasures of environmental health and law enforcement is also for law enforcement main body and relative person both unfolding, including strengthening law enforcement team legal literacy, to distinguish between the responsibilities of various departments, through the performance appraisal to improve the efficiency of law enforcement, through the hearing of the masses supervision and law enforcement, improve relative to the level of law enforcement, strengthening environmental health legal advocacy, public sanitation establishment of a mutual supervision mechanism, to create a noble cause of sanitation between social atmosphere, the law enforcement main body interaction and supervision.

1. 绪论

随着社会主义市场经济的发展，我国在城市化进程中在享受经济发展带来的红利的同时，也在经受着环境卫生状况日益恶化的状况。虽然我国在加强环境卫生执法方面做出了许多工作，但环境卫生状况并没有得到十足有效的改善，环境污染问题和不讲究卫生状况依然屡见不鲜。从此可以看出，我国在环境卫生执法上依然存在着诸多困境有待解决。我国的环境卫生执法工作基本上是由环保局和城管等相关部门协同进行的，其中的权责问题依然存在诸多交叉错杂等问题，是而引起了相关行政部门的执法推诿，从而导致了部分环境卫生状况不达标区域或危害环境卫生状况的行为成为“三不管”的区域和行为。另外，环境卫生执法者的执法方式的不当甚至非法也是促成环境卫生执法存在困境的一个重要原因。
