摘 要

为改善残疾人社会生活质量，推进残疾人保障事业的可持续发展，2007年中国残疾人联合会正式将残疾人托养服务提上工作日程，托养机构随之在全国各地建立，与托养机构相关的残疾人权益问题也随之出现。

本文在文献研究法的基础上，试图通过对相关文献资料的解读，从法律的角度探析有关残疾人托养机构的问题。文章以学界对国内外残疾人托养研究视角出发，对比发现我国残疾人托养问题研究存在的不足。对残疾人相关概念进行界定，深入认识残疾人这一群体，并对当前我国托养机构现状进行分析，结合托养机构涉及的相关法律政策对托养机构相关立法进行解读。此外，近年来托养机构在各地纷纷建立，与托养机构有关的法律规范问题、合同问题以及侵权问题也随之出现，如何在制度上和实践中解决这类问题是保障残疾人托养机构建设的关键所在，本文试图对此类问题进行解读，提出相应的解决之道，引起相关部门对该问题的重视，规范残疾人托养机构的建设管理。

Abstract

In order to improve the quality of life of the disabled community, and promote the sustainable development of the cause of protection of the disabled in 2007, China Disabled Persons' Federation officially on Disabled care support services mentioned work schedules, child care support along with agencies established throughout the country, and care support Disability Rights issues related to the organization began.

In addition, in recent years have established care nursing homes in the country, legal and regulatory issues related to the care support agencies, as well as contractual issues infringement also will appear, how to solve these problems in the system and in practice is to protect the institution of Care for Disabled key construction, the paper tries to interpret these problems, propose appropriate solutions, the problem caused by the relevant departments of the attention, regulate the construction management of persons with disabilities care support agencies

第1章 绪 论

1.1背景及意义

根据国家统计局数据及第二次全国残疾人抽样调查数据显示，2015年我国残疾人口数量达到8500多万，约占全国人口的6.34%，这个占比对于我国社会承受力而言相对较大。此外，由于一些不可避免的个人及社会因素，我国的残疾人以每年70-80万的增长速度不断上升，而在这数量庞大的残疾人人群中，只有36.2%的残疾人得到托养，并且是以家庭供养为主,其他的托养方式在现实生活中并没有普及，家庭供养的压力大^[1]。

自人类社会存在以来就有残疾人，残疾是人类进化及社会发展的产物，残疾人问题是人类社会的共性问题^[2]。在人道主义的理念下，给予残疾人这一特殊群体的帮助是基本的要求。但是人们对于残疾人问题的认识并不是一蹴而就的，其曾经历了一系列质的变化，从最初的怜悯到对残疾人存在的认可到对残疾人价值认同，思想也由传统人性理念、人道主义、人权思想到为人类社会共同发展思想，人们对于残疾人的认识及观念在与时俱进的时代里逐步形成科学的残疾人观。不过，传统的残疾人观念却没有在新科学残疾观的发展过程中消灭殆尽，残余的传统思想仍旧将“残疾”和“残废”相混淆，部分人潜意识里依旧认为残疾人只可依附他人，甚至将其视作社会的负担，将残疾人排斥在主流的社会生活之下，给残疾人社会生活带来严重困扰。
