摘 要

现如今，在2020年全面建成小康社会、全面脱贫攻坚战的决胜时期，农村经济发展拥有着前所未有的重要地位。在现有经济模式下，土地是一切生产和存在的源泉，其利用对一国制度极其运行有重要影响，在我国，农村土地利用制度也是土地制度中不可或缺的重要组成部分。在此背景下，构建和落实符合实际要求的可持续发展土地资源，不仅是农村文明在建设和发展过程中的基础，同时也是推动农村经济振兴和经济发展的必要前提。

当前，全国农地流转整体加速，与此相对应的，我国法制建设在快速发展的土地流转制度保障上仍然存在着滞后的现象，但是尚且缺乏一部完整具体且全面的农村土地流转法律条例以统筹地方参差不齐的规章和部门间相互冲突的规定。在当前农业现代化发展进程中，总体上，立法规范已趋于完善，各项条例的出台弥补法律空白、使得立法进入规范化的阶段，但由于各地经济发展水平不一，农业发展程度不同等，条例实施依然存在问题需进一步完善。另外，由于一些错误观念所导致的农村土地的不合理的利用模式破化了农村本就脆弱的生态系统，也阻碍了我国农村土地的可持续化利用。究其原因，主要是我国在法律规范上存在很多不足导致的，纵观我国现存的有关农村土地保护的法律法规，无不简单、笼统，未能形成一套完整的法律体系，从整体上系统全面的将各种问题列入其中。本文以我国乡村土地利用程序为纵轴，我国乡村土地利用主要分为土地流转和经营权的确立、土地利用方式、土地利用效益（正效益、负效益）三个主要方面。以目前立法、执法现状为横坐标，将我国乡村土地制度现存问题放入，有针对性地寻找我国乡村土地利用的法律障碍因素及其影响程度。通过阻碍因素加之国外乡村土地利用法律制度借鉴对我国乡村土地利用法律制度现存问题提出提升解决路径以及发展方向。

Abstract

Now, in the decisive period of building a well-off society in an all-round way and overcoming poverty in an all-round way in 2020, rural economic development has an unprecedented important position. In the current economic model, land is the source of all production and existence, and its utilization has an important impact on the operation of a country's system. In China, the rural land use system is also an indispensable part of the land system. In this context, the construction and implementation of sustainable development land resources in line with the actual requirements is not only the foundation of rural civilization in the process of construction and development, but also the necessary prerequisite to promote the revitalization of rural economy and economic development.

At present, the whole country's rural land transfer is accelerating. Correspondingly, there is still a lag phenomenon in the protection of the rapid development of the land transfer system in China's legal construction, but there is still a lack of a complete and comprehensive rural land transfer laws and regulations to coordinate the rules and regulations with uneven local participation and conflicting provisions between departments. In the current process of agricultural modernization development, generally speaking, the legislative norms have tended to be improved. The introduction of various regulations makes up for the legal gaps and makes the legislation enter the stage of standardization. However, due to the different levels of economic development and agricultural development, there are still problems in the implementation of the regulations that need to be further improved. In addition, the unreasonable use of rural land caused by some misconceptions has broken the fragile rural ecosystem and hindered the sustainable use of rural land in China. The main reason is that there are many deficiencies in our country's laws and regulations. Throughout the existing laws and regulations on rural land protection in China, they are all simple and general, and fail to form a complete set of legal system, which systematically and comprehensively includes various problems. Taking the rural land use procedure as the vertical axis, this paper divides the rural land use into three main aspects: the establishment of land circulation and management right, the way of land use, and the benefit of land use (positive benefit and negative benefit). Taking the current situation of legislation and law enforcement as the abscissa, this paper puts the existing problems of rural land system into consideration and looks for the legal obstacles and their influence degree of rural land use in China. Through the barrier factors and the reference of foreign rural land use legal system, the paper puts forward the solution path and development direction for the existing problems of rural land use legal system in China.

第一章 我国乡村土地利用现状和存在的问题

1.1乡村土地利用法律制度现状

1.1.1 乡村土地利用法律制度含义

土地利用，即权利人为满足需要，按照土地的自然性能和用途加以使用的行为或法律事实。土地利用法律制度，即调整人们在土地利用过程中所发生的以土地为内容的各种社会关系的法律规范的总称。其目标是在协调分类使用现有土地达到最大经济效益的同时注重生态系统和生态环境的协调可持续发展。其具体内容包括土地权属划分、利用规划、征收补偿以及土地资源保护等土地资源利用环节的全过程。

本文所称农村土地，又称乡村土地，主要是指依据《农村土地承包法》第二条、第三条和《土地管理法》第四条规定的包括耕地、林地、草地以及四荒土地在内的农民集体所有和国家所有但依法由农民集体使用的用于农业的土地。
