摘 要

数字时代下音乐作品的版权保护面临新的危机，而区块链在国家政策与利益机制的双重驱动下，积极寻求与其他行业的结合。网络时代音弱化了音乐作品的权利人对作品排他性的控制能力，给作品的传播、使用与保护带来了新的困境。区块链技术的技术特征则有利于加强权利人对作品的控制，从而维护现有的数字音乐保护体系。

首先，结合数字音乐产业的实践情况，总结互联网时代音乐产业存在的现实困境。在互联网冲击下权利人对音乐作品的控制力减弱，造成侵权行为泛滥，而互联网的隐蔽性也为权利人维权带来困难。音乐产业的发展中，参与主体的复杂化使得各方之间的利益失衡，许可成本与传播效率之间的矛盾日益突出。与此同时，音乐集体管理组织由于管理效率低下，许可费定价争议等问题，难以发挥其维护权利人合法权益的积极作用。

其次，结合区块链的技术特征与数字音乐版权保护的需要来看，区块链能发挥促进数字音乐产业发展的积极作用，但也具有其技术难以逾越的障碍。区块链的底层技术、共识机制以及合约机制，能够帮助建立正版音乐数据库，缓解侵权诉讼中举证难的问题，并为版权交易的当事人提供安全、高效的交易平台。同时，集体管理组织站在区块链技术的基础上，能够提高其运行的透明度以及效率，重新建立权利人对集体管理组织的信赖。但区块链技术的高成本、平台构建标准的不统一、链下事实的信赖问题以及意思自治上的瑕疵，严重制约了区块链发挥其积极作用。

最后，结合区块链技术落地的障碍以及音乐产业运营的现状，提出适合区块链发展的不同阶段的具体建议。根据现阶段区块链的技术发展情况来看，应当以区块链存证作为推行的主要运行模式，帮助权利人解决诉讼中举证难的困境。未来区块链技术发展成熟后，为充分发挥其技术优势，即可采取保护与交易一体的运行模式，从而发挥区块链对数字音乐保护与发展的积极作用。

Abstract

The copyright protection of music works in the digital age is facing a new crisis, and the block chain is actively seeking to combine with other industries under the dual drive of national policy and interest mechanism. In the network age, the sound weakens the copyright proprietor’s ability to control the exclusivity of the works, and brings new difficulties to the dissemination, use and protection of the works. The technical features of blockchain technology are beneficial to strengthen the control of the works by the copyright proprietor, thus maintaining the existing digital music protection system.

Combined with the practice of digital music industry, this paper summarizes the realistic predicament of music industry in the Internet era. Under the impact of the Internet, the right holder's control over music works is weakened, resulting in widespread infringement, and the concealment of the Internet also brings difficulties to the rights holder. In the development of music industry, the complexity of the participants makes the interests of all parties out of balance, and the contradiction between licensing cost and communication efficiency is increasingly prominent. At the same time, the music collective management organization is difficult to play its positive role in safeguarding the legitimate rights and interests of the copyright proprietor because of the low efficiency of management and the dispute over the pricing of license fees.

According to the technical characteristics of block chain and the need of digital music copyright protection, block chain can play a positive role in promoting the development of digital music industry, but it also has its technical insurmountable obstacles. The underlying technology, consensus mechanism and contract mechanism of block chain can help to establish authentic music database, alleviate the problem of difficult proof in tort litigation, and provide a safe and efficient trading platform for the parties to copyright transaction. At the same time, the collective management organization stands on the basis of block chain technology, which can improve the transparency and efficiency of its operation, and re-establish the trust of the copyright proprietor to the collective management organization. But the high cost of blockchain technology, The non-uniform standard of platform construction, the trust problem of the facts under the chain and the flaw of autonomy seriously restrict the block chain to play its positive role. Combined with the obstacles of blockchain technology landing and the current situation of music industry operation, the specific suggestions suitable for different stages of blockchain development are put forward. According to the technical development of block chain at the present stage, it is necessary to take block chain certificate as the main operation mode to help the copyright proprietor solve the difficult dilemma of proof in litigation. After the development of blockchain technology in the future, in order to give full play to its technical advantages, we can adopt the operation mode of integrating protection and transaction, so as to exert the blockchain to digital music the positive role of protection and development.

区块链通过其独有的技术特征，能够在竞争环境中低成本地建立信任的计算范式。随着全球数字化、信息化与智能化的不断推进，区块链作为数字时代的前沿科技，因其具有推动数字行业发展的巨大动能，成为各行各界重点关注的对象。与此同时，数字时代下音乐作品版权保护也面临新的危机。研究背景主要包括如下方面：
