摘 要

网络游戏虚拟财产是互联网发展与社会进步的产物，伴随互联网的迅速发展，其发展速度也超出了人们预期，给人们生活带来娱乐的同时也对现行法律体系带来了全新的挑战，日益增多的虚拟财产纠纷案件没有让司法实践开辟出一条足够清晰和准确的途径。至今为止关于网络游戏虚拟财产的权利属性及其变动规则仍旧处于争论当中，法律对于该权利的规定也是相对空白和欠缺。本文旨在通过研究从网络游戏虚拟财产的性质到发掘其法律性质，探索出其主要的权利变动规则，最终反作用于实际。

本文详细的主要内容主要从以下几个方面展开：

第一，对网络游戏虚拟财产权利的研究背景和意义进行简单阐述，分析国内外的研究现状表明研究的必要性和现实意义。

第二，对网络游戏虚拟财产有一个最基本的定位和认识，简单论述网络游戏虚拟财产的特征，同时从科学，经济学上对其进行定义，为后面权利性质的分析和权利变动规则的研究奠定基础。

第三，再进一步分析其法律方面的权利分析，包括对其权利性质分析的必要性，再通过对比阐述当下流行的几种关于其权利性质的学说后进行总结归纳。

第四，在对网络游戏虚拟财产有了一个准确的认识之后，就可以开始对其权利变动的规则进行深一步的探究。基于其权利性质对其权利变动，包括权利取得，变更，消灭多个方面再继续深入分析，探索其权利变动的规则。同时，不能忽略其不同于其他法律关系的特性，对其特性产生的权利变动的特殊性和局限性进行分析，存在哪些例外和局限性。

Abstract

With the rapid development of the Internet, the development speed of virtual property of online games has exceeded people's expectations, bringing entertainment to people's lives and new challenges to the current legal system. The increasing number of virtual property disputes has not opened up a clear and accurate way for judicial practice. Up to now, the property right and its changing rules of virtual property of online games are still in dispute, and the provisions of the law for this right are relatively blank and lack. The purpose of this paper is to explore the main rules of the change of rights through the study of the nature of virtual property of online games to explore its legal nature, and finally react on the reality.

The main contents of this paper are as follows:

First, the research background and significance of virtual property rights of online games are briefly described, and the research status at home and abroad shows the necessity and practical significance of the research.

Second, it has a basic position and understanding of the virtual property of online games. It briefly discusses the characteristics of the virtual property of online games, and defines it scientifically and economically, which lays the foundation for the analysis of the nature of rights and the study of the rules of rights change.

1.1 研究的背景和意义

伴随计算机和互联网的发展，网络游戏及其衍生产业以不可阻挡的气势席卷而来，在中国呈现飞速发展的趋势，俨然成为与传统娱乐行业难分伯仲的新兴产业。不同于很多传统的单机电子游戏，网络游戏因为联机这一属性使得游戏中的虚拟装备，虚拟人物等虚拟财产具有了交易价值，成为了许多网游玩家追求和消费的核心内容。此外，伴随手机的普及，手机网络游戏的发展也呈现了一发不可收拾的恐怖架势。根据CNNIC的报道，截止2020年3月，我国网络游戏用户规模达5.32亿，较2018年底增长4798万，占网民整体的58.9%；手机网络游戏用户达5.29亿，较2018年底增长7014万，占手机网民的59.0%。可以看出，网络游戏产业自在我国兴起以来一直饱受广大网民的喜爱，如今更是成为了提升生活品质不可或缺的一部分。与之相对应的是，人们在网络游戏中的消费金额投入愈多，花费精力投入也越来越多，追求优秀的游戏账号达到优秀的游戏体验已经成为一种趋势，甚至成为一种产业。在这样的背景下，涉及网络财产的案件也日益增多，但是现行的立法体系及司法实践并没有给予这种社会现状充分的回应，关于网络游戏虚拟财产的界定与权利性质确认以及司法救济的提供都还不够清晰。

网络游戏虚拟财产的发展已经产生了诸多现实问题，法律适用上的不清晰和混乱，极有可能导致的是个人的网络游戏虚拟财产权得不到有效的保护，也很容易造成相关市场的畸形发展，研究网络游戏虚拟财产的变动规则，制定出一套完整的网络游戏虚拟财产权利变动规则模型，既有利于解决法律适用的问题，降低司法难度，减轻司法成本。同样也对当下很多现实问题有着重大积极的作用，明确网络游戏虚拟财产变动规则，有利于保护财产权人的合法权利，让图谋不轨者心怀望而却步，让财产持有者更有信心也有途径实现自己的权利救济，同样也能有效地规范相关的市场，创造出公正平等的市场环境，建立恰当的市场规则，促进该市场的发展和进步，最终达成促进该产业发展和国家经济的发展。
