摘 要

世界各国对于刑法制度的不断改革，使得对缓刑犯罪人员的处理方式由残酷蛮横转向缓和文明，社区矫正作为一种缓和化的非监禁性刑罚方式因运而生。采用社区矫正极大程度地缓解了监狱压力。而对于被宣告缓刑的犯罪人员进行社区矫正可以最大化程度使他们在与社会不完全脱节的情况下，通过政府与社会如企事业单位、志愿者等社会资源的共同帮助，减小他们回归社会的阻碍。本文主要分为三大部分，最开始第一部分通过回顾我国社区矫正中对缓刑犯进行矫正教育的发展背景以及发展意旨，同时分析国外的发展现状。第二部分从矫正措施、监督管理和制度体系这三方面分析我国南京市缓刑犯社区矫正存在的发展不足。最后第三部分根据第二部分分析的不足之处提出相关的建议。

An empirical study on community correction of probation offenders -- Taking Nanjing as an example

Abstract

System reform of criminal law in different countries of the world, making the probation crime personnel handling from the brutal road to moderate civilization. Community correction, as a kind of mitigated non-custodial penalty, has emerged due to the operation. Community correction, as opposed to incarceration, greatly alleviates prison stress.However, community correction can maximize the degree of the suspended offenders who are not completely separated from the society and reduce the obstacles to their return to the society through the joint help of the government and the society, such as enterprises, public institutions, volunteers and other social resources. This paper is mainly divided into three parts. At the beginning, the first part reviews the development background and intention of correction education for suspended offenders in community correction in China, and analyzes the current development situation in foreign countries. The second part analyzes the development of community correction of suspended offenders in nanjing from three aspects: correction measures, supervision and management, and system system. Finally, the third part puts forward relevant Suggestions according to the deficiencies of the second part.
