摘 要

乡政府和村民委员会（以下简称村委会）是我国农村的管理机构，两者在不同层面服务村民。然而法律上简单规定的指导协助关系为后期村委会行使自治权设置屏障，乡政府往往由于缺乏指导协助公务的界限，将大量公务下派给村委会，甚至将其变相变成乡政府的一个下辖机构。在实务中由于乡村治理的复杂性和多变性，两者之间公务协作现象在所难免，本文试从程序上限制乡政府与村委会的公务混乱的现象，只有用程序来规制实体，才能为后期的责任承担和纠纷解决提供依据，才能进一步保障村委会的自治权。

论文使用文献研究、实地调查以及系统分析等方法对我国乡政府与村委会公务关系进行研究，分为三部分。第一部分，介绍乡政府与村委会的基本概念和法律地位。第二部分，阐述乡政府与村委会在现实操作中的关系。第三部分，系统介绍两者的公务协作制度，从程序上规制协作步骤，为后期纠纷的解决提出可行性措施。

Study on the relationship between town government and village committee

Abstract

The town government and the village committee are the authorities in rural China. They serve the villagers at different levels. However the guidance assisted by the simple provisions of the law sets barrier to the exercise of the autonomy of the village committee in the later period, and the town government, due to the lack of guidance to assist the official line, sends a lot of official business to the village committee, and even turns it into a subordinate body of the township government. In practice, due to the complexity and multiplicity of rural governance, it is inevitable that there will be official cooperation between the two. This paper tries to restrict the chaotic phenomena of the government and village committee in the program. Only by using the program to regulate the entity, can it provide the basis for the later liability and dispute settlement, so as to further guarantee the autonomy of the village committee.

The paper uses literature research, field investigation and system analysis to study the relationship between town government and village committee. It is divided into three parts. The first part introduces the basic concept and legal status of town government and village committee. The second part expounds the relationship between the town government and the village committee in the practical operation. In the third part, the system introduces the system of the relationship between the two, not only from the program, but also to the solution to the later dispute.
