网络游戏交易中虚拟财产之权属变动研究毕业论文

摘 要
近年来,网游产业的发展速度之快为我们有目共睹,然而经过对相关文献资料的查阅,笔者发现,对于网络游戏虚拟财产交易这一网游行业的主要运营模式,现有的研究比较少。即使有一些相关的文献资料,主要也是从网络游戏虚拟财产交易本身或者网络游戏虚拟财产的属性入手,对于交易过程中的权属变动问题无人问津。与此同时,在立法层面上,相关问题的法律制度仍是空白,这对司法实务产生了不可忽视的影响,同案不同判的尴尬状况层出不穷,这显然是不利于缓和各方利益主体的矛盾纠纷的,也对网游产业的发展造成了一定程度的阻碍。这一问题是解决网络游戏虚拟财产交易中权利归属争议的第一步,也是尤为关键的一步,因此笔者希望以此为中心展开深入的研究。
本文共分为四个部分:
- 分为网络游戏虚拟财产概述。该章明确了网络游戏虚拟财产的内涵和外延,并对其概念进行了说明。
第二部分为网络游戏虚拟财产交易模式与权利变动的关系。首先对网络游戏虚拟财产交易的范畴进行了界定;然后介绍了网络游戏虚拟财产的几种不同的交易模式;最后就网络游戏虚拟财产交易模式对权利变动的影响进行了分析。
第三部分为其它司法区域有关虚拟财产交易的制度对比研究。分别介绍了美国、韩国和我国台湾地区对这一问题的不同规定,由此为我国相关制度的设计提供借鉴。
第四部分为网络游戏虚拟财产交易中规则之创新。该部分内容首先对网络游戏虚拟财产的权利属性进行了界定,其次又介绍了物权法上的权利变动规则,再次将网络游戏虚拟财产与物进行对比分析,而后又就网络游戏虚拟财产交付的认定问题作了说明,最后对不同交易模式下的权属变动规则进行了创新。
由于目前相关立法的空缺,因此本文在结合现有制度的基础上,进行了大量的创新研究,力求为有关立法的完善做出理论贡献。

ABSTRACT
In recent years, the speed of development of the online game industry is obvious to us. However, after reviewing the relevant literature, the author finds that there are few existing studies on the online game industry's main operating model of virtual property transactions. Even if there are some relevant documents and data, it is mainly from the online game virtual property transaction itself or the properties of the online game virtual property, no one cares about the problem of ownership changes during the transaction process. At the same time, at the legislative level, the legal system of related issues is still blank, which has a non-negligible impact on judicial practice. The embarrassing situation of different judgments in the same case emerges in an endless stream. This is obviously not conducive to alleviating the contradictions of the parties concerned. Disputes also hinder the development of online game industry to a certain extent. This issue is the first and most critical step in resolving disputes over ownership of rights in online game virtual property transactions. Therefore, the author hopes to conduct in-depth research on this issue.
This article is divided into four parts:
The first part is an overview of online game virtual property. The chapter clarifies the connotation and extension of online game virtual property and explains its concept.
The second part is the relationship between online game virtual property transaction mode and rights change. First, it defines the category of online game virtual property transactions; then it introduces several different transaction modes of online game virtual property; finally, it analyzes the impact of online game virtual property transaction modes on rights changes.
The third part is the comparative study on the system of virtual property transactions in other jurisdictions. The different regulations on this issue in the United States, South Korea, and China's Taiwan region were respectively introduced, which provided references for the design of related systems in China.
The fourth part is the innovation of rules in online game virtual property transactions. This part first defines the rights property of online game virtual property. Secondly, it introduces the rights change rule of property rights law. It compares and analyzes online game virtual property and property again, and then determines the issue of online game virtual property delivery. In the end, the author made innovations in the rules of ownership changes under different trading patterns.
Due to the vacancy of current related legislation, this paper has carried out a large amount of innovation research on the basis of the existing system, and strives to make theoretical contributions to the improvement of relevant legislation.
