摘 要

随着工业化和市场经济的快速发展，高校作为知识产权创造的主力、作为知识创新和技术创新的重要基地,肩着创造自主知识产权的重任。高校知识产权保护及运用水平直接关系到国家知识产权战略的构建和实施,直接关系到创新型国家建设的进程。为配合创新型国家建设方针的实施,提高高校知识产权水平,本文重点研究了高校知识产权主体在参与知识产权工作中创造、保护、运用和管理几个过程中的基本现状,分析了当前高校知识产权工作中各参与主体存在的创造不足、流失严重、保护不善、经营不顺畅等问题,提出了构建统一协调的高校知识产权管理体系、完善激励机制、促进科技成果转化、争取政府支持、形成“官产学研”相结合的新机制等具体措施。

本文着眼于宏观与微观的双重视角,采用理论与实践相结合，研究了高校知识产权的参与主体在知识产权的创造、运用、保护、管理等工作中的具体作用和责任,倡导形成高校知识产权责任明确、能够充分激励高校教师和学生从事技术创新,实现高校知识产权效益最大化的良性循环工作体系，为建设创新型国家的目标服务^[1]。可见，研究高校知识产权管理工作中各参与主体的作用与责任不仅具有一定的理论价值,更具有极强的现实意义。

Abstract

With the rapid development of industrialization and market economy, as the main force of intellectual property creation and as an important base for knowledge innovation and technological innovation, colleges and universities shoulder the responsibility of creating independent intellectual property rights. The level of protection and application of intellectual property rights in Colleges and universities is directly related to the construction and implementation of the national intellectual property strategy, which is directly related to the process of building an innovative country. In order to cooperate with the implementation of the construction policy of the innovative country and improve the level of intellectual property rights in Colleges and universities, this paper focuses on the present situation of the creation, protection, application and management of the intellectual property rights subject in the work of intellectual property rights in Colleges and universities, and analyzes the lack of creation and the severe loss of the participants in the current intellectual property work in Colleges and universities. Some specific measures, such as the construction of a unified and coordinated system of intellectual property management, the improvement of the incentive mechanism, the transformation of scientific and technological achievements, the promotion of government support, and the formation of a new mechanism of combination of government and research and research, are put forward.

This paper, focusing on the dual perspective of macro and micro, adopts the research method combining theory with practice, domestic experience and foreign experience. It aims to promote the formation, application, protection and management of the participants of intellectual property rights in Colleges and universities, and promote the formation of a good cycle chain of intellectual property rights in Colleges and universities and encourage college teaching. 第一章 绪论

1.1背景

人才培养、科学研究、社会服务和文化传承创新是高校的四项基本功能。高校是我们国家科技创新体系的重要组成部分，高校创造的知识产权是技术创新的重要源泉，也是我国知识产权的主要来源。知识产权虽然是私权但是有很强的公益性，主要追求利益平衡。知识产权只有实现个人利益特别是知识产权权利人的利益和社会整体利益之间的平衡与协调，才能实现对社会资源合理的配置，促进技术的创新。而作为实现这些利益平衡的高校知识产权相关参与主体而言，首先就需要正确定位各自的角色，明确自身在高校知识产权工作中的具体职责，相互合作，共建各种合作机制来协同发挥知识产权的作用，促进我国高校知识产权的积极创造、有效保护和充分运用，促进高校知识产权工作的的有效管理和有序运行，从而加快我国创新型国家的建成，促进社会发展。

1.2目的

本文主要以我国高校知识产权参与主体为主要研究对象，运用文献研读法、系统分析法和实证调查的防范,认真剖析了我国高校知识产权主体在知识产权创造、保护、运用、管理等几个方面工作中的角色定位和职责分工，分析了存在的问题及产生的原因,并提出了具体的合作机制。

1.3意义

本文认为高校知识产权主体在高校知识产权工作中至关重要，是该充分发挥作用。高校知识产权管理工作最终目的是要实现知识产权的市场价值。因此要明确各参与主体在知识产权工作中的角色定位及具体职责，分析各参与主体在知识产权工作中的利益和风险，分析高校知识产权参与主体在参与知识产权工作中可能面临的问题及产生的原因，并提出如何有效合理地发挥各自的作用和职责，通过建立相关的合作机制来实现各参与主体之间的协同效应，，以期为充分发挥我国高校知识产权工作中各参与主体的主观能动性，为促进我国高校知识产权工作的持续改进与完善,推动我国创新型国家建设提供具体建议和启发。
