摘 要

城管部门是为更好地管理城市、促进城市可持续发展而创立的，但自创立后出现了许多暴力执法、职权交叉的问题，政府为此也在进行不断的改革创新，例如实施城市管理综合行政执法。城市管理综合行政执法的实施对于解决部门间推诿扯皮现象、理顺城市管理执法体制及促进社会和谐稳定等方面起着重大作用。而让公众参与城市管理综合行政执法更是有助于城市管理部门加强对公众的真实需求的了解、更好地履行职能并提高行政执法水平和效率。通过近几年的探索实践，各地在公众参与方面取得了不少成效，但随之也暴露出了很多问题，亟待解决。

本文以新公共管理理论和治理理论为理论基础，分析公众参与的合理性和必要性。通过研究我国现阶段公众参与城市管理综合行政执法的现状，总结公众参与的成效及存在的问题，并针对问题提出解决对策。

Status, Problems and Countermeasures of Public Participation in Comprehensive Administrative Law Enforcement in Urban Management

ABSTRACT

The urban management department runs for managing the city better. However, many problems have arisen, such as cross-authority and violent law enforcement. For this reason, the government is carrying out continuous reforms and innovations, such as the implementation of comprehensive administrative law enforcement in urban management. After carrying out comprehensive administrative law enforcement, the phenomenon of cross-authority and violent law enforcement has led to a decline. The society has also been more harmony and stability. What’s more, the implementation of public participation is helpful for the urban management department to strengthen the understanding of the true needs of the public, perform its functions better and improve the level and efficiency of administrative law enforcement. Through many years’ exploration and practice in public participation, local governments have achieved some success. Meanwhile, we are supposed to pay much attention to solving the existing problems.

 Based on the analysis of academic theory and relevant policies, this paper points out that public participation is necessary to comprehensive administrative law enforcement in urban management. What’s more, by studying the situation of public participation, this paper also summarizes the success and problems of public participation and proposes some practical solutions from three dimensions.

一、 绪论

（一）研究背景及意义

1. 研究背景

改革开放以来，在党中央的领导下，各地的生产力水平、科学技术及产业结构都在不断地提高和优化，我国城市人口和规模也在大幅度增长。2019年时中国已有130个百万人口城市。^[1]城市人口数量的激增与人们对于高质量生活的需要，使城市建设管理显得至关重要。

随着城市建设的深入发展,城市管理问题日渐凸显。为完善城市管理执法体制，地方各级政府从市容环境卫生入手，设立了监察队伍。随着对城市管理执法体制的深入探索，党的十八届三中全会、四中全会都在文件中明确提出了有关城市管理执法工作的要求，并提出要推进城市管理综合行政执法。由于城管执法的范围与公众生活密切相关，公众参与城市管理综合行政执法就有助于城管切实了解公众的真实需求，提高执法的效率与质量。党中央在有关报告中也多次强调公众参与的必要性，如十九大报告中强调要形成完整的制度程序和参与实践，保证人民有广泛持续深入参与的权利，十九届四中全会也提出必须完善包括公众参与在内的社会治理体系。

2. 研究意义

随着城市人口数量的增加及公众对于美好生活的需求不断提高，城市管理中的公共问题也日益增长，对于城市管理综合行政执法的要求也相应地提高，传统的由政府担任唯一行政执法主体的单向且强制的执法模式已经不适应新时代的管理需求了。为顺应时代特征，现代城市管理应转变执法模式，以服务为先，以人为本，采取简政放权、放管结合的管理方法，鼓励多元主体参与城市管理。
