摘 要

最近几年，随着互联网的飞速崛起，公益众筹的发展越来越快。基于互联网的众筹模式为公益项目提供了人力、物力和财力支持。但因没能及时跟进国家的法律制度和社会管理，我国发生了很多负面事件，使得公益众筹在我国面临巨大危机：很难对捐款纠纷问题进行明确的定性、对众筹平台的资料审核不够公开透明、对众筹获得的资金管理不规范、人与人之间的信任大大降低。对我国网络公益众筹的现有问题进行针对性的分析，并在此基础上建立相关的法律监管机制，不仅是学界内专家们的关注重点，也能够对我国网络公益众筹的良好发展起到正面作用。

本文查阅了大量文献，在前人分析的基础上针对性地提出问题，并发布调查问卷进行具体分析。结果发现，人的主观意愿、社会的信任度及监管情况等都是影响网络公益众筹发展的重要因素。因此，在借鉴发达国家治理经验的基础上，根据我国的实际国情，提出网络公益众筹规范化发展的相关建议，从政府、企业和社会公众三个方面作出分析，旨在推动网络公益众筹的良性发展。

Research on the development dilemma and governance of China's public welfare crowdfunding

Abstract

In recent years, with the rapid rise of the Internet, the development of public crowdfunding has been faster and faster. The internet-based crowdfunding model provides human, material and financial support for public welfare projects. But failed to follow up the country's legal system and social management, many negative events have happened in our country, make public the raise face a huge crisis in our country, it is hard to dispute for donations to clear qualitative, a lack of transparency for the literature review of the raised platform, to raise money management is not standard, the trust between people is reduced greatly. A targeted analysis of the existing problems in China's network public crowdfunding and the establishment of relevant legal supervision mechanism on this basis are not only the focus of experts in the academic circle, but also play a positive role in the good development of China's network public crowdfunding.

This paper consulted a large number of literature, put forward questions on the basis of previous analysis, and issued a questionnaire for specific analysis. The results show that people's subjective will, social trust and supervision are all important factors affecting the development of public welfare crowdfunding. Therefore, on the basis of referring to the governance experience of developed countries and according to China's actual national conditions, this paper puts forward relevant Suggestions on the standardized development of network public welfare crowdfunding, and analyzes from the three aspects of the government, enterprises and the public in order to promote the benign development of network public welfare crowdfunding.
