摘 要

随着经济和科技的不断发展，我国逐步进入信息化时代。然而，我们一边在享受着信息带给我们便利，与此同时有关个人信息的保护问题也变得越来越紧张。个人信息经常被一些非行政组织所侵害，行政机关对个人信息的监管与保护力度也不够。为了保护个人信息安全，我国急需建立《个人信息保护法》，构建完善的保护机制。

本篇文章以互联网时代下保护个人信息为研究背景，并且结合国内与国外目前的研究状况，随后开展了保护公民个人信息的理论研究。首先，描述了在互联网时代这个大背景中，我国关于保护个人信息目前所存在的问题，包括商业机构以贩卖个人信息为生、互联网引擎泄露公民个人信息、企业未能妥善处理公民个人信息等。其次，分析了目前存在的关于个人信息的保护问题所产生的原因，包括缺乏专门保护个人信息的法律、公民对保护个人信息的这一意识相对薄弱、行政机关监管职能、救济不完善等。最后，通过阐述西方先进国家对于保护个人信息所采取的有效的措施并进行借鉴与分析，提出完善的保护个人信息安全的法律法规的建议，共同构建和谐的信息社会。

Research On the protection of personal information in internet age

Abstract

With the continuous development of economy and technology, China has entered the information age step by step. However, while we are enjoying the convenience brought us information, at the same time the protection of personal information has become increasingly nervous about. Personal information is often violated by some non-administrative organization, the administrative organ of supervision and protection of personal information are inadequate. To protect personal information security, China needs to establish "Personal Information Protection Law" and build a sound protection mechanism.

This article under the age of the Internet to protect personal information on the background and combined with domestic and foreign research present situation, carry out theoretical research on protection of personal information on this basis. First of all, it directly pointed out the current problems in the protection of personal information in China, including commercial organizations relying on the sale of personal information, Internet engines leaking personal information of citizens, and companies failing to properly handle personal information of citizens. Secondly, the reasons of personal information existing problems, including the lack of specific legislation, citizens of personal information protection awareness is weak, the executive regulatory functions, imperfect remedy. Finally, by elaborating on the measures taken by advanced Western countries to protect personal information, and drawing on their advanced research methods, they put forward suggestions to improve laws and regulations related to personal information protection, and jointly build a harmonious information society.

1.研究背景

当今社会，信息作为一种重要的资源，推动了社会与经济的发展。在这些信息中，个人信息种类尤为多，内容十分丰富，范围相对较广。并且它作为管理的基础、决策的依据，是社会活动不可或缺的资源。当前，由于科学技术的不断进步使得收集公民的个人信息变得十分的方便、快捷。但是因为这一行为缺乏有效的监管程序，使得公民的个人信息没有得到妥善的处理而被泄露出去的情况时有发生。这些被泄露出去的个人信息被有心人士恶意利用，会对信息主体的生命安全、财产安全等造成严重的伤害，存在着较大的安全隐患。
