摘 要

随着网络信息技术的发展、公民维权意识的提高，网络维权已经成为公民最有效地维权方式，为了适应网络的发展、维护公民的权益，政府必须重视公民网络维权并做出有效地回应，因此研究这方面的内容是具有十分重要的意义的。

本文首先对公民网络维权、政府回应及相关概念进行介绍。接着有选择地对我国近来发生的公民网络维权事件进行分析，考察在其中政府回应公民网络维权的方式、特点。然后分别从维权方式角度和政府回应方式角度分析目前的网络维权的现状及政府回应公民网络维权的现状。最后从政府回应主体、回应客体、回应渠道、回应效果这四个方面具体分析和探讨政府回应公民网络维权还存在回应力不足、回应渠道不畅通等问题，并针对问题，提出转变回应态度、畅通回应渠道、加强绩效评估等改进回应的对策，从而实现政府与民众的良性关系，在公民网络维权和政府回应之间形成良性互动，促进社会有序发展。

Abstract

With the development of network and information technology, improvement of awareness of civil rights, the rights network has become citizens of the most effective means of protection, for the purpose of adapting to the development of the network, to the protection of the citizen’s rights and interests, the government must pay attention to network citizen rights and make effective response. Therefore, the study of the content is of great significance.

In this paper, we first introduce the network rights, the government response and related concepts. Then has the choice to our country recent citizen network rights protection event to carry on the analysis, the government in response to the way the government to respond to the rights of citizens. Then analyze the status quo of the network rights protection and the government’s response from the perspective of the way of safeguarding the rights and the way of the government’s response. Finally from the four aspects of the government’s response to the subject, object, channels, the effects specific analysis and discussion of government response to the rights of the citizen network there are still lack of response, response channels unimpeded, and to solve the problem provided a improved response strategies change response attitude, smooth response channels, strengthen performance evaluation etc. so as to achieve a healthy relationship between the government and the public, in the civil rights and the government to respond to the formation of positive interaction between the government and promote orderly social development.

一、公民网络维权的政府回应研究概述

（一）研究背景及意义

1．研究背景

政府回应理论最早起源于西方，在上世纪60年代政府回应就受到外国学者的关注，上世纪80年代以来，西方有些国家就提出将增进回应性和效率作为政府的目标，各国政府和学术领域也逐渐开始关注这方面的话题。

国外对于政府回应这个主题的研究有很多，涵盖了政府回应的内涵研究、能力研究、机制研究、问题研究、对策研究等多个方面。相对来说，国内对于政府回应的研究开始得较晚。关于政府回应理论方面研究，国内学者比较认同西方学者研究的对于政府回应的价值内涵，在此基础上又提出了另外一种认识，把“政府回应”理解为一种政府行为和政治过程。原丁在《服务型政府回应力研究》（2013）中指出政府回应是一个互动的过程，实际上是政府还政于民，它包含职责范围内的回应、诉求式回应、责任性回应和更高层次上的回应这四个层次。^[1]关于政府回应的问题方面研究，在《网络问政中政府的回应性问题研究》中李婧雅、田丽莎指出政府回应方面存在着政府工作人员回应意识淡薄，回应不透明、不及时，政府与公民的沟通不畅等问题并对问题进行了详细的分析。关于政府回应的对策方面研究，方小龙在《网络问政视域下政府回应机制建构》中提出要更新政府的行政思维，明确回应主体，畅通网络渠道，明确回应和办理时限，加强回应过程的监督，加强回应效能考评等对策。以此来建立更有效的回应型政府。
