摘 要

在当今全球化的背景下，伴随世界经济一体化的加强和各国贸易的自由化趋势，知识产权对我国经济发展的贡献作用越来越大，全世界的目光都开始聚焦在这里。其中，像发展中国家在专利的保护和创新上面是远远地不够和那些发达的国家相抗衡的，这样的不佳处境又制约着这些发展中国家的前进。这篇撰写的论文第一步由知识产权壁垒的基础含义着手，接着在中国出口企业这一方面来设身处地地看待面临的知识产权壁垒的现状以及所分类出来的各种类型，从而讨论该障碍对企业的影响程度，最后根据探究的结论，从企业实际方面对中国出口企业的可持续发展提出几点对策建议。

Analysis of Intellectual Property Barriers in International Trade

-- To China's Export Enterprises as An Example

Abstract

In the current context of globalization, with the trend of liberalization of strengthening the integration of the world economy and trade countries, intellectual property contribution to China's economic development is more and more big, the traditional tariff and non-tariff barrier to eliminate the barriers of intellectual property rights at the same time, began to receive more and more attention, gradually become an important adjustment the way to maintain the trade interests of all countries in the world. Among them, the developing countries in the development of economy and technology level with the developed countries there is a big gap, so most are at the disadvantageous position, and in the process of intellectual property in our country and a series of developing countries have an important impact.

This paper from the basic concept of the intellectual property barrier, and then to China export enterprises status and form analysis of intellectual property barriers, so as to discuss the impact of intellectual property barriers on China's export trade enterprises, finally according to the conclusions, of intellectual property barriers for China export enterprises to better cope with the developed country from the reality of our country, put forward some countermeasures and suggestions to promote the sustainable development of China's foreign trade.

第一章 引言

1.1 知识产权壁垒的国内外研究现状

针对本次选择的论文主题，笔者通过互联网、指导老师以及图书馆查阅的各种渠道中找寻了众多的相关资料，在此过程中逐渐开始了解关于本论题的国内外研究现状。对于国内学者关于知识产权壁垒的研究基本上没有形成系统的论调，换句话说，对于知识产权壁垒的具体概念也是各说各话，没有达成一种共同的观念。其中有一些优秀的学者和专家依然提出了极为鲜明独特的论述，如：郑秉秀在2002年第五期“国际贸易问题”发表的论文《国际贸易中的知识产权壁垒》，基本上写明了知识产权壁垒的界定和性质，也写到了针对性的回应，是目前为研究奠定基础的一篇论文；郑成思、韩秀成两个人所编著的《知己知彼，打赢知识产权之战》，把中国设立的知识产权法和TRIPS协议做了一些比较，讲到了一些外国人在中国市场上利用专利的担忧，提醒国人提高预防意识；龙永图写过一本《入世与知识产权保护》，为国人别开生面地讲述国际产权规则的各类注意事项，对我国产权制度创新作用很大。

国外的学者对这一领域的研究基本上都围绕着Trips协议，Edwin L一 C. Lai和Larry D. Qiu的 《The North's Intellectual Property Rights standard for the South?》说到，南北国家假定是同一层次的产权维护水准，那么发达国家唯有减少壁垒，反向促进发展中国家的专利发展，结果，不发达国家遵守TRIPS规则时会增加双赢几率；Keith E.Maskus和Mohaned Lahouel在《Competition Policy and Intellectual Property Rights in Developing Countries》中,建议发展中国家要利用好WTO这一机制，促进竞争法的公正性，反对不公平的贸易往来，在知识产权的制度框架里提高本国的专利创新，不然发达国家依然会为了维护自己的绝对优势，垄断技术，垄断专利，国外的专家以及学者基本上在Trips协议的基础上侧面界定了知识产权壁垒。
