摘 要

2018年3月，贸易战正式打响，中美贸易战在本质上是一场知识产权大战，是美国政府妄想借由“301条款”打击中国在新兴科技知识产权方面表现出的竞争力。在这场贸易战中，美国指责中国企业“窃取”美国的知识产权，并且向WTO提起诉讼。面对中美贸易纠纷逐渐升级的情况，中国企业在走出国门的过程中，尤其需要重视知识产权问题。目前来说，知识产权已经不只是关乎企业生死存亡的关键问题，更是与整个国家的发展息息相关。所以本文探究了美国发动贸易战的深层次知识产权原因，并分析了在贸易战下重视知识产权问题的重要性，从而总结出贸易战中的企业在知识产权方面可能面临的机遇和挑战，并针对这一情况提出相应的应对措施。

Opportunities and Challenges for Chinese Entrprises in the Field of Intellectual Property under the Background of Sino-US Trade War

Abstract

In March 2018, the trade war officially started. The Sino-US trade war was actually a war of intellectual property rights. It was the Trump administration's attempt to combat China's competitiveness in emerging intellectual property rights through the “Article 301”. In this trade war, the United States accused Chinese companies of "stealing" US intellectual property rights and filed suit against the WTO. In the face of the escalation of Sino-US trade disputes, Chinese companies in particular need to pay attention to intellectual property issues in the process of “going out”. The issue of intellectual property rights is not only a question of the competitiveness of enterprises themselves, but also an issue of international economic security. Therefore, this article explores the reasons for the deep intellectual property rights of the United States to launch a trade war, and analyzes the importance of attaching importance to intellectual property issues under the trade war, thus summarizing the opportunities and challenges that enterprises may face in the intellectual property rights under the trade war, and this situation proposes corresponding countermeasures.

第一章 贸易战与知识产权概述

1.1 知识产权的概念

知识产权是指知识产权的权利人对自己的智力成果所享有的一种专有的权力，一般只在有限时间内有效。我国的知识产权制度起步相对较晚，在国际上的摩擦争端不断，随着我国经济和科技的发展，为了更好保护产权人的利益，知识产权制度应运而生并不断完善。

1.2 中美贸易战概述

中美的贸易摩擦一直是双方贸易的焦点问题，一直以来，中国的出口贸易不断遭受到美国的反倾销反补贴的调查，两国的贸易摩擦也在逐渐升温。在2018年年初，特朗普政府正式公布了“301”条款调查报告，报告中之指出，要对中国约500亿美元的商品加征25%的关税，到2018年年底，中美贸易战已经经历了三个回合，美国对中国的贸易制裁分别为500亿美元、2000亿美元、5000亿美元^[1]。美国在特朗普就任后就相继退出了TPP（Trans-Pacific Partnership Agreement）和巴黎气候协定，这是典型的“美国利益优先”的表现，而此次的贸易战则是更加加深了美国逆全球化的进程。
