摘 要

论文的研究目的是在充分对国内外专利申请情况进行研究的基础上分析我国的优势与不足，进而立足自身，为新能源汽车构建一个良好的知识产权机制和安全稳定的发展环境。

论文主要研究了我国新能源汽车的知识产权发展策略。首先构建了知识产权的相关理论以作为本文的基石，进而对新能源汽车专利申请进行了分析。了解了国内外的专利研究现状，并根据分析数据得出了目前中国新能源汽车领域的优劣点，进而扬长避短，对我国新能源汽车的发展在战略方向上进行了统筹规划。

研究结果表明若想使得新能源汽车取得长足发展，必须从国家和企业的知识产权战略层面入手。在企业层面，笔者将从如何建立知识产权机制、如何进行专利创新、如何对专利信息及专利资产组合管理提出了意见；在国家层面，笔者主要根据域外纠纷事件向国家提出了应对策略，并呼吁政府可以对我国现存的专利制度进行改进，合理有效地构建国内的专利共享库，并再一次强调了中国新能源汽车知识产权的战略布局。

本文特色是将知识产权的理论与国内外新能源汽车的专利申请系统地结合了起来，根据我国新能源汽车专利申请的优劣势进行了知识产权战略方面的统筹规划，并提出了专利共享库、专利联盟等大胆设想，为新能源汽车发展提供了宝贵意见。

Abstract

The purpose of this paper is to analyze the advantages and disadvantages of China based on the research of domestic and foreign patent applications, so as to build a good intellectual property mechanism and a safe and stable development environment for new energy vehicles.

Thesis mainly studied the intellectual property rights of China's new energy vehicle development strategy first to build the related theory of intellectual property rights as the foundation of this article, and then analyses the new energy automobile application for a patent for understanding the patent research status both at home and abroad, and according to the analysis of data obtained in the field of new energy vehicles in China currently and disadvantages, and thus foster strengths and circumvent weaknesses, the development of new energy vehicles in China has carried on the overall planning on the strategic direction.

The research results show that in order to make new energy vehicles achieve long-term development, it is necessary to start from the level of national and enterprise intellectual property strategy. At the enterprise level, the author proposes Suggestions on how to establish intellectual property mechanism, how to carry out patent innovation and how to manage patent information and patent portfolio. At the national level, the author puts forward countermeasures to the country based on foreign disputes, and calls on the government to improve China's existing patent system, reasonably and effectively build a domestic patent sharing library, and once again emphasizes the strategic layout of China's new energy vehicle intellectual property rights.

研究背景

如今天下大势，无外乎经济和技术，然而被人忽视最多的便是关于知识的竞争。诚然，科技是第一生产力，但是科技是需要知识产权作为其支撑的，没有知识产权作为其根基，科技便如空中楼阁一般没有立足点，也缺乏了安全感与竞争力。

而如今，资源枯竭，能源问题突出，譬如美英德等大国都已经开始聚焦新能源汽车，并投资了大量的物力人力财力来促进其发展，并且出台了相关的政策来鼓励这个新兴行业。一个企业要想提高其竞争力，那么必定离不开知识产权，知识产权是一个企业想要进行国际经营的总抓手。纵观我国新能源汽车行业，虽然已经在知识产权方面取得了不小的成功，但其所存在的问题也是不容忽视的^[1]。所以，我们就必须对知识产权的战略意义有一个清晰的认知，从自身出发，构建知识产权战略体系，并且在产品附加值上家功夫，进而抢先登陆新能源汽车产业发展的高地，将我国的新能源汽车行业打造为极具竞争力的国际优势产业。
