摘 要

随着科学技术的不断提高和互联网的发展，它已经成为我们生活中不可或缺的一部分。互联网接入到我们的生活之后，我们的生活质量提高了很多，无论是在生活上还是在工作上，在娱乐上对我们的生活带来了很多的便利。网络技术的发展对我们生活的介入带来了许多便利的同时也很多作品的传播领域带来了一场革命，网络媒体时代的到来给传统媒体和版权体系带来了挑战。在互联网时代，由于网络技术的飞速发展，网络音乐已成为音乐的重要组成部分。但与此同时，互联网的“双刃剑”作用还处在进行式，互联网带来便利的同时对网络音乐这一块儿产生了许多的挑战以及威胁。 由于中国对数字版权保护的保护措施并不是很好或不是很高，数字音乐在开发过程中遇到了很多挫折。

互联网每时每刻都在对我们的生活实施者“双刃剑”的作用，它不仅仅是为了给大众提供便利，提供了相对的利益也是给很多人带来了不便以及造成了权益的失衡。互联网拓宽了人们的视野，获得了更多的知识，并改变了人们的生活方式和思维模式。人们可以通过互联网交换信息和传播信息，成为人们工作，工作和娱乐中不可或缺的一部分。 利用互联网最方便最快捷最为实用的一部分的同时也要谨慎互联网带给我们生活的一些列大小问题，利用有利的部分，避免有害的部分。

互联网深入到人们的每个生活阶段，例如娱乐方面人们也离不开互联网因为休闲娱乐已被互联网包含在里面，享受音乐也在其中。 因此，音乐产业牢牢抓住这一机遇在互联网环境下发展音乐产业，这使数字音乐快速发展的同时也让人们得到了许多的便利。人们可以每时每刻在不同的地点收听自己喜爱的音乐。音乐爱好者则是可以创作歌曲。

文章探讨了音乐版权协会在收集和支付音乐版税以及新的分发方式如何影响他们的作品方面所发挥的作用。它着重于几个关键领域：设备和交付方式的融合，使消费者能够随时随地听他们想要什么，何时何地；互联网对国际音乐许可框架的影响。

Abstract

With the development of science and technology, the Internet has become an indispensable platform for everyone. After the Internet has stepped into our lives, the quality of life has improved a lot, and the Internet has brought a lot of convenience to our lives. The development of network technology has brought about a profound revolution in the field of works dissemination. The copyright system has a history of 300 years and has been challenged unprecedentedly due to the arrival of the Internet media era. In this era of rapid development of the Internet, digital music has gradually become an important part of music and occupies an important position in the music industry in China. At the same time, however, the "double-edged sword" role of the Internet is still in progress. While the Internet brings convenience, it also poses many challenges and threats to online music. The Internet plays an important role under the protection of network copyright laws. Because China has very limited levels of digital music copyright protection, the digital music industry has encountered many difficulties in its development.

From the day of its creation, the music industry has become the most complicated area of institutional design in the copyright law. Among them, there are many rights subjects and multiple types of rights. Historically, many licensing models such as statutory licenses and centralized licenses were first born in the field of music copyright. The reason is that the complexity of the rights system and the diversification of utilization methods always necessitate the use of new types of licensing models to regulate the interests of industry entities. 网络技术不停地发展为信息的网络化传输带来了很多的便利以及新领域，人们的生活进入了全新的网络时代。网络技术的不断冲击，音乐产业再次受到挑战。互联网的出现，给人们带来了无限的便利的同时，也同样给让人们陷入了深深的的忧虑之中。无论是信息还是作品，大家都可以利用互联网对信息和作品进行未经许可的利用比如复制，改编。对利用互联网满足需求的大众来说，这是一种福利，而对与作者，权利人来说这是一场灾难，著作人失去自己作品所有权的同时也失去了，劳动给他带来的利益。由此，网络上的版权如何保护的问题凸显出来。

1.1.2 研究意义

自2013年“互联网 ”时代到来以来，原本在互联网时代便已经蓬勃发展的数字音乐产业迎来了自身的又一次腾飞。互联网技术的飞速发展另一方面也对数字音乐版权的法律保护提出了新的、更大的挑战。无论是网络搜索服务提供者侵权案件的频发，还是新型对等网络侵权事例的层出不穷。使得网络盗版音乐的传播更加便利，无论是自媒体等新型版权侵权事件的涌现，还是版权收益分配失衡所导致的不良后果，都使得“互联网 ”时代数字音乐的版权法律保护问题成为了当下影响深远、需要解决的重要课题。我认为对我们需要对我国网络音乐版权保护的现状和存在的问题进行研究，分析并解决这一问题是非常重要的，所以我们需要对我国在互联网 时代下的网络音乐版权保护的问题进行研究及提出相应的建议。

音乐作品可以说是人类最早智力的成果，如今音乐产业在世界经济和国家发展中具有一定的影响力。随着数字化进程的发展，新技术的出现，由于音乐作品自身的特殊性使其最先受到了侵害，对此应当采取相应的措施。
